A homestead exemption protects home equity from a homeowner’s creditors, up to a certain dollar amount. Collectors cannot acquire any funds within this amount to settle past-due debt. This applies if you file for bankruptcy or you experience financial difficulties after a divorce or your spouse passes away. You can also get a California homestead exemption on property taxes, in which you’re taxed on the value of your home minus the exemption amount.
CA’s minimum homestead exemption (HSE) are based on median home prices that adjust each year with inflation. Currently it is $361,110 and maximum is now $722,220, effective 1/1/25. Final inflation numbers may increase these amounts.
For homes in Riverside or San Bernardino Counties, median home prices should be around: $500,000 for SB and $636,000 for Riverside.
CA also has a homestead exemption problem when the debtor has an ADU or the property is a duplex/multi-unit property. So, owners of ADU’s must be extra careful before filing bankruptcy.
